Ashley Merlo represents clients in a wide variety of general business litigation, employment litigation and intellectual property matters.

Professional Highlights

Ms. Merlo’s litigation experience includes complex breach of contract claims, business tort claims such as fraud, unfair business practices and misappropriation of trade secrets, as well as trademark and copyright infringement claims. Highlights include:

  • Successful arbitration of a breach of contract claim resulting in a sizeable award to our client and complete defense against the opposing parties’ $4 million claim for fraud.
  • Obtaining dismissal of a fraud claim against a client pursuant to California’s anti-SLAPP statute.
  • Second chairing a four week jury trial in a breach of contract action resulting in a verdict in favor of a client in excess of
    $5 million.
  • Second chairing a jury trial in a trademark infringement action against a client resulting in a defense verdict and a finding that client demonstrated priority of use of the disputed mark.

In addition, Ms. Merlo has successfully represented clients in connection with the prosecution of trademarks and inter partes proceedings before the Trademark Trial and Appeal Board.

Ms. Merlo previously was an associate with the Orange County office of Sheppard Mullin Richter & Hampton LLP.

Ms. Merlo is a past president and former member of the Orange County Bar Foundation Associate Board.

Ms. Merlo is also a member of the Orange County and Contra Costa Bar Associations and a member of the Litigation section of the State Bar.


Ms. Merlo graduated Order of the Coif and magna cum laude from the University of California, Hastings College of the Law. Ms. Merlo also was an editor for the Hastings Business Law Journal and a brief writer and oral advocate on the Hastings labor law moot court team. Before attending law school, Ms. Merlo earned her bachelor’s degree from Stanford University where she graduated with distinction and as a Collegiate All-American athlete.
